A GAL is a court-appointed attorney who represents the interests of the child(ren) in a case, gathering information and providing recommendations to the court.
A Guardian ad Litem (GAL) is a court-appointed attorney who represents the best interests of child(ren) in legal proceedings, particularly in cases involving custody disputes, abuse, or neglect. The GAL is tasked with investigating the circumstances of the case, interviewing the child(ren), parents, and other relevant parties, and making recommendations to the court about what is in the best interest of the child(ren). The GAL’s role is to provide an independent voice for the child(ren), ensuring that their needs and preferences are considered by the court.
The GAL will file various documents throughout the case, including reports on their findings, recommendations, and any motions or objections they believe are necessary to protect the child(ren)’s interests. These documents are critical to the court’s understanding of the child(ren)’s situation and often carry significant weight in the final decisions about custody and parent time. The GAL’s involvement can be particularly important in complex cases where the parents are in significant conflict or where there are allegations of abuse or neglect.
While the GAL is an advocate for the child(ren), their recommendations are not binding on the court. The judge or commissioner will consider the GAL’s input along with other evidence and arguments presented by the parties. However, given the GAL’s specialized role and focus on the child(ren)’s welfare, their recommendations are often highly influential in the court’s final decisions. The involvement of a GAL adds an additional layer of protection for child(ren) in legal proceedings, ensuring that their voices are heard and their best interests are prioritized.
