A Custody Evaluation hearing is a hearing where a Custody Evaluator assesses both parties and the child(ren) and provides recommendations to the court regarding custody and parent-time arrangements.

Details

A Custody Evaluator is often requested where there is a dispute over custody or parent time. A Custody Evaluator, who is typically a mental health professional, is appointed to conduct a thorough investigation into the family dynamics, including interviews with both parents, the child or children, and sometimes other relevant parties including significant others. The evaluator also reviews the Court filings and any other pertinent information, such as school and medical records, to make an informed recommendation to the Court.

The hearing on a request for a custody evaluation is where the court decides whether to grant the request and appoint a custody evaluator. This hearing is important because the evaluator's recommendation carries significant weight in the Court’s final decision regarding custody and parent time.

The court takes these recommendations very seriously, as they are based on an in-depth analysis of what is in the best interest of the child(ren). The hearing may also address issues such as the division of the costs of the evaluation and the timeline for the evaluator to complete their report.
