Typical Hearing Schedule

  • At Matheson, Law and Order calendars are Mondays 9 and 10; Second and Fourth Tuesdays at 9 and 10; and First and Third Wednesdays at 9 and 10.  
  • Thursdays at 9 and 10 are Protective Orders; Pre-trials and CMCs on Thursday beginning at 1:30.  
  • Miscellaneous in afternoons because the time is used to prepare for the following day and to write under advisements.

Typical Time Allotment by Hearing Type

  • There is no "typically".  It depends on the number of other cases on the calendar at the same time and the complexity of the case.

Hearings Where Parties are Not Required to Personally Attend

  • CMCs, pre-trials, some review hearings, and those who can show good cause.

Hearing Types: In-person vs. Remote

  • In my experience, there is a significantly better chance of the attorneys and parties discussing a case and possibly coming to a resolution if everyone attends in person.  This includes Motions for Temporary Relief and Motions to Enforce.

Timeline for Virtual Link or Call Information

I use a static.

Motion to Appear Remotely Circumstances

Good cause can consist of living out of town beyond the Wasatch Front, illness, conflicts, etc.  It is not good cause if an attorney takes a case in a different district along the Wasatch Front.

Matters [besides those listed in Rule 101(m)] Scheduled in front of a Judge without Commissioner Review

None.

"Expedited" Hearing Circumstances

It must be for cause and there must be a reason the matter cannot or should not be heard under Rule 101.

Preferred Exhibit Submission Method

Efile a summary and bring hard copies to the hearing.  If it is an audio or video exhibit, it needs to be filed far enough in advance for my Judicial Assistants to have it cleaned.

Review Hearing or Status Conference Requests

In writing with a description of why one is requested.

Pretrial and Trial Scheduling

The parties or their counsel obtain dates from the Judicial Assistants via email.  Notices go out via e-filing or hard copy.  DO NOT REPLY to the Judicial Assistants or Reply All until and unless you contact the other party/counsel and agree on a date or until and unless you try to get this type of input and the other side is ignoring you.
